  • Radius and service area data

3.4 Payment Data

Payments are processed through Stripe, Inc. We do not store full payment card information on our systems. Please review Stripe's Privacy Policy for details on how payment data is handled by that service.

3.5 Technical Data

  • IP address and device information
  • Logs, usage activity, and system interactions
  • Cookies and session data

4How We Use Data

We use collected data for the following purposes:

  • Generating quotes, invoices, and operational records
  • Processing payments and managing billing

  • Improving Platform performance and functionality

5Automation & System Processing

The Platform may automatically perform the following operations:

  • Match customers based on provided data
  • Generate quotes, invoices, and documents
  • Update payment and job statuses
  • Link records across system components

These automated processes are provided for operational efficiency and may not always be error-free. The Company makes no warranty as to the accuracy of automated outputs.

6Data Accuracy Disclaimer

You acknowledge and agree that:

  • Data is provided by users and third parties and may be incomplete or inaccurate
  • We do not guarantee the accuracy, completeness, or reliability of any data on the Platform
  • Automated matching and processing may produce incorrect results

The Company is not liable for errors, losses, or damages resulting from incorrect, incomplete, or outdated data.

7Payments & Financial Processing

All payments are processed via Stripe, Inc. or similar third-party payment processors. With respect to payment processing, the Company:

  • Does not store full card details or sensitive payment credentials
  • Does not control third-party payment systems or their availability
  • Is not liable for payment processor errors, outages, or failures

All payment obligations remain between the customer and the Company as described in the applicable invoice or service agreement.

8Quotes, Invoices & Transactions

  • Quotes are estimates only and are not binding until formally accepted by both parties
  • Invoices are due and payable as stated on the invoice
  • Payment links and hosted payment pages are provided for convenience only
  • The Company is not responsible for misuse of shared payment links or unauthorized access to payment pages

9Account & Access Control

9.1 User Responsibilities

All users of the Platform must:

  • Provide accurate and current information
  • Maintain the security of their account credentials
  • Not share login credentials with unauthorized individuals

9.2 Staff & Administrative Access

  • Access to the Platform is role-based (Admin, Manager, Staff, Viewer)
  • User actions may be logged and monitored for security and operational purposes
  • Managers and administrators may have elevated permissions including the ability to modify or delete data

9.3 Suspension & Termination

The Company reserves the right to suspend or terminate access to the Platform at any time, with or without notice, for reasons including but not limited to misuse, security risks, or violation of these terms.

10Data Sharing

The Company does not sell personal data to third parties. We may share data in the following circumstances:

  • With service providers necessary to operate the Platform, including Stripe, Inc.
  • With legal authorities when required by applicable law or valid legal process
  • With business partners for operational purposes, subject to confidentiality obligations

11Security

We implement reasonable technical and organizational safeguards including:

  • Encryption of data in transit
  • Role-based access permissions
  • Activity logging and monitoring

However, no system is fully secure. Use of the Platform is at your own risk, and the Company cannot guarantee the absolute security of any data transmitted to or stored on the Platform.

  • Maintain accurate business and financial records
  • Comply with applicable legal and regulatory obligations

15Intellectual Property

All content, systems, software, processes, and materials on the Platform are the exclusive property of Egan Agricultural or its licensors and are protected by applicable intellectual property laws. Users may not copy, reproduce, distribute, modify, reverse engineer, or create derivative works from any part of the Platform without the prior written consent of the Company.

16Limitation of Liability

To the maximum extent permitted by applicable law, the Company, its officers, directors, employees, and agents shall not be liable for any:

  • Data inaccuracies or errors in automated outputs
  • Service interruptions, downtime, or unavailability
  • Payment failures or third-party processor errors
  • Actions or omissions of third-party service providers
  • Loss of data, revenue, profits, or business opportunity
  • Indirect, incidental, special, consequential, or punitive damages

This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if the Company has been advised of the possibility of such damages.

17Indemnification

You agree to indemnify, defend, and hold harmless the Company and its officers, directors, employees, agents, and successors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

  • Your use of or access to the Platform
  • Any data, content, or information you provide
  • Your violation of these terms or any applicable law
  • Your infringement of any third-party right

18Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. The Company does not warrant:

  • Continuous, uninterrupted, or error-free availability of the Platform
  • That defects or errors will be corrected
  • The accuracy, completeness, or reliability of any outputs or results

19Force Majeure

The Company shall not be liable for any delay, failure, or interruption in performance resulting from causes beyond its reasonable control, including but not limited to natural disasters, acts of God, government actions, internet or telecommunications outages, cyberattacks, or failures of third-party service providers.

20Governing Law

This Policy and any disputes arising from or related to your use of the Platform shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of law provisions. Any legal action or proceeding shall be brought exclusively in the state or federal courts located in Wisconsin.

21Changes to Policy

The Company reserves the right to update or modify this Policy at any time without prior notice. Changes will be effective upon posting to the Platform.
